These Terms of Service ("Terms") govern your access to and use of the website, applications, APIs, and AI marketing services (collectively, the "Services") provided by BLUECORE TECHNOLOGY PTE. LTD. ("BLUECORE", "we", "us", "our"), a company incorporated in Singapore. By accessing or using the Services you agree to be bound by these Terms.
Business use. The Services are provided for lawful commercial and marketing purposes. If you are using the Services on behalf of an organization, you represent that you are authorized to bind that organization to these Terms.
"Client Content" means data, briefs, product information, brand assets and instructions you provide. "Generated Output" means creative variants, scripts, images, videos, recommendations, and reports produced by the Services. "Documentation" means the technical and operational documentation we make available in connection with the Services.
You must be at least the age of majority in your jurisdiction to use the Services. You are responsible for the accuracy of information provided during account registration, for maintaining the confidentiality of credentials, and for all activity that occurs under your account.

We may modify, add, or remove features from time to time. Material changes will be reflected in these Terms or the Documentation.
As between the parties, you retain ownership of Client Content and, subject to payment of fees and compliance with these Terms, you own the Generated Output produced specifically for you. BLUECORE retains all rights in the Services, models, algorithms, infrastructure, and any generic or reusable components. You grant BLUECORE a limited license to use Client Content solely to provide and improve the Services.
Generated Output is produced using AI systems and may contain inaccuracies. You are responsible for reviewing and approving Generated Output before deploying it in campaigns or public channels. BLUECORE does not warrant that Generated Output will be free of errors, non-infringing, or suitable for any particular audience or regulatory context.
Fees, payment terms, and refund policies are set out in the applicable order form or service schedule. Amounts are exclusive of taxes, which are payable by the client where applicable. Unpaid amounts may be suspended, disabled, or terminated after reasonable notice.
Each party will treat non-public information disclosed by the other party as confidential and will use it only to perform its obligations under these Terms, protecting it with the same standard of care as its own confidential information (and no less than reasonable care).
The Services are provided on an "as is" and "as available" basis. To the maximum extent permitted by law, BLUECORE disclaims all warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant specific commercial outcomes such as clicks, conversions, or revenue.
To the maximum extent permitted by law, BLUECORE will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or business opportunities. Our aggregate liability for any claims arising out of or relating to these Terms will not exceed the fees paid by you to BLUECORE in the twelve (12) months preceding the event giving rise to the claim.
You will indemnify and hold BLUECORE harmless from third-party claims arising out of your breach of these Terms, your misuse of the Services, or your Client Content, subject to reasonable notice and cooperation.
We may suspend or terminate access to the Services for material breach of these Terms, non-payment, or where required to protect the Services or third parties. Either party may terminate for convenience in accordance with the applicable order form. Sections that by their nature should survive termination will survive.
These Terms are governed by the laws of Singapore, without regard to its conflict of laws principles. The parties submit to the exclusive jurisdiction of the Singapore courts, subject to any arbitration clause in an applicable order form.
We may update these Terms from time to time. The "Last updated" date at the top of this page reflects the effective date. Continued use of the Services after changes constitutes acceptance of the revised Terms.
